By visiting, accessing, or using the website, you agree to be bound by these Terms of Use, our Privacy Policy, the applicable Official Sweepstakes Rules, the Refund Policy, and any other policies, guidelines, notices, disclosures, rules, or legal terms published by ITSALL4GOOD LLC from time to time, all of which are incorporated herein by reference and form part of this agreement.

In these terms of use, the words “website” and “platform” refer to the ItsAll4Good website, “we”, “our”, and “IA4G” refers to ITSALL4GOOD LLC, and “user” refers to you, the user of IA4G.

5. PURCHASES AND DIGITAL PRODUCT ACCESS

5.1. IA4G offers family-friendly digital products, including storybooks, activity packs, printable materials, sticker sheets, creative resources, and other digital goods that may be made available through the website from time to time. Users may purchase individual products, bundles, or other offerings made available by IA4G. By placing an order, the user agrees to provide accurate and complete purchase information and authorizes the processing of the applicable payment through the payment methods and payment service providers supported by the website.

5.2. Upon successful completion of a purchase and confirmation of payment, users will be granted access to the purchased digital products through My Library, email delivery, downloadable files, read-only access, or any other digital delivery method designated by IA4G. The method of access may vary depending on the nature of the product and the delivery options selected by IA4G. Users are responsible for maintaining access to the email address associated with their account and for ensuring that they have the necessary devices, software, internet connectivity, and technical capabilities required to access and use purchased digital products.

5.3. IA4G makes reasonable efforts to provide continuous access to purchased products through My Library; however, users acknowledge that access may be temporarily unavailable due to maintenance, updates, technical issues, security measures, service interruptions, or circumstances beyond IA4G's reasonable control. IA4G reserves the right to modify, update, replace, improve, or discontinue digital products, delivery methods, website features, or access systems at any time, provided that such actions do not materially deprive users of access to products they have already purchased.

6. REFUND POLICY

6.1. All purchases made through the IA4G website are subject to IA4G's Refund Policy, which is incorporated into these Terms and Conditions by reference. Users are responsible for reviewing the Refund Policy before making a purchase. The eligibility, requirements, limitations, procedures, and conditions applicable to refunds, credits, cancellations, or other purchase-related matters shall be governed exclusively by the Refund Policy in effect at the time of the transaction.

7. DIGITAL PRODUCT LICENSE

7.1. Subject to compliance with these Terms and Conditions and the successful completion of a purchase, IA4G grants users a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use purchased digital products solely for personal, family, and non-commercial purposes. No ownership rights in any digital product, content, design, illustration, storybook, activity pack, printable product, sticker sheet, PDF, or other material are transferred to the user as a result of a purchase.

7.2. Purchased digital products may not be copied, reproduced, distributed, shared, published, sold, sublicensed, rented, transferred, assigned, displayed, or otherwise made available to any third party without the prior written consent of IA4G. Users may not resell digital products, include them in commercial offerings, use them for commercial printing purposes, offer them for sale in physical or digital form, upload them to websites, marketplaces, file-sharing platforms, social media platforms, cloud storage services intended for public distribution, or any other location where they may be accessed, downloaded, copied, or distributed by others.

7.3. Storybooks and other designated view-only products are licensed exclusively for viewing through the access methods provided by IA4G and may not be downloaded, copied, extracted, reproduced, or converted into other formats unless expressly authorized by IA4G. Downloadable products that are specifically designated as downloadable may be downloaded and printed by the purchaser solely for personal or family use. Such authorization does not permit commercial use, commercial printing, mass reproduction, resale, redistribution, public distribution, educational distribution for a fee, or any other commercial exploitation of the products.

7.4. Any use of a digital product beyond the limited license granted under these Terms and Conditions is strictly prohibited and may result in the suspension or termination of access to the website, the revocation of product access rights, and the pursuit of any legal or equitable remedies available to IA4G.

8. SWEEPSTAKES

8.1. IA4G is operated in connection with sweepstakes sponsored by ITSALL4GOOD LLC. Eligible purchases made through the website may include entries into the current sweepstakes as described on the website and in the applicable promotional materials. Participation in any sweepstakes is subject to eligibility requirements, entry limitations, winner verification procedures, prize fulfillment requirements, geographic restrictions, and other conditions established for the applicable promotion.

8.2. No purchase is necessary to enter or win a sweepstakes. A free alternative method of entry is available, and a purchase does not increase the chances of winning. Each sweepstakes is governed by a separate set of Official Sweepstakes Rules, which contain important information regarding eligibility, entry methods, entry periods, prize descriptions, winner selection procedures, verification requirements, restrictions, and other terms applicable to the promotion. By participating in any sweepstakes, users agree to be bound by the applicable Official Sweepstakes Rules in addition to these Terms and Conditions.

8.4. Users are responsible for reviewing the Official Sweepstakes Rules before participating in any sweepstakes. In the event of any inconsistency between these Terms and Conditions and the Official Sweepstakes Rules regarding a sweepstakes, the Official Sweepstakes Rules shall govern and control with respect to the applicable sweepstakes.

8.5. In the event of any inconsistency between these terms of use and the applicable Official Sweepstakes Rules regarding Sweepstakes eligibility, entry methods, entry limits, odds, winner selection, prize fulfillment, charitable donation administration, or other Sweepstakes-specific matters, the applicable Official Sweepstakes Rules shall control with respect to those Sweepstakes-specific matters.

9. LIMITATION OF LIABILITY

9.1. To the fullest extent permitted by applicable law, ITSALL4GOOD LLC, IA4G, and their respective owners, officers, directors, managers, employees, contractors, affiliates, licensors, service providers, and business partners shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or relating to the use of, inability to use, or reliance upon the website, digital products, sweepstakes, user accounts, My Library, product access systems, communications, third-party services, or any content made available through the website, regardless of the legal theory asserted and even if advised of the possibility of such damages.

9.2. IA4G does not guarantee that the website, digital products, downloads, account features, communications, product access systems, sweepstakes, or related services will operate without interruption, error, delay, security incident, or technical issue. Users acknowledge that the availability and performance of the website and its services may be affected by maintenance activities, software updates, internet disruptions, third-party service interruptions, equipment failures, security events, force majeure events, or other circumstances beyond the reasonable control of IA4G.

9.3. ITSALL4GOOD LLC shall not be responsible for any loss of data, loss of access to digital products, loss of content, loss of business opportunities, loss of goodwill, interruption of activities, unauthorized access to accounts, user mistakes, misuse of products, reliance on website content, or damages resulting from the acts, omissions, services, products, systems, or policies of third-party providers, including payment processors, hosting providers, storage providers, email service providers, analytics providers, internet service providers, or other vendors utilized in connection with the operation of the website.

9.4. Users assume full responsibility for their use of the website, participation in sweepstakes, access to digital products, and reliance upon any information, content, or materials made available through the website. Such protected materials include, without limitation, storybooks, activity packs, printable products, sticker sheets, illustrations, artwork, characters, text, graphics, designs, layouts, photographs, audio, video, software, source code, compilations, databases, product collections, branding elements, logos, trademarks, service marks, website content, and all other materials available through the website or provided as part of any digital product.

10.2. Except for the limited license expressly granted under these Terms and Conditions, no ownership rights, intellectual property rights, or other proprietary interests are transferred to users through access to the website or the purchase of any digital product. All rights not expressly granted are reserved by ITSALL4GOOD LLC and its licensors.

10.3. Users may not copy, reproduce, modify, adapt, translate, create derivative works from, distribute, publish, display, transmit, sell, sublicense, license, rent, lease, reverse engineer, exploit, or otherwise use any portion of the website or any digital product except as expressly authorized by these Terms and Conditions or by prior written consent from ITSALL4GOOD LLC. Any unauthorized use of the website, digital products, or intellectual property belonging to ITSALL4GOOD LLC may constitute a violation of intellectual property laws and may result in the suspension or termination of access to the website, the revocation of licenses granted under these Terms and Conditions, and the pursuit of any legal or equitable remedies available to ITSALL4GOOD LLC.

11. USER-SUBMITTED CONTENT

11.1. Users may voluntarily submit content, communications, feedback, reviews, suggestions, questions, survey responses, photographs, videos, testimonials, statements, recordings, files, or other materials to IA4G through the website, customer support, sweepstakes administration, promotional activities, social media, email, or other communication channels (collectively, "User-Submitted Content").

11.2. By submitting User-Submitted Content, the user represents and warrants that they have the right to submit the content and that the submission does not violate any law, contractual obligation, privacy right, publicity right, intellectual property right, or other right of any person or entity.

11.3. IA4G may review, edit, moderate, remove, decline to publish, or decline to use User-Submitted Content in its discretion, subject to applicable law. Users remain responsible for the User-Submitted Content they submit.

11.4. Winner Promotional Materials. A verified winner is not required to provide a photograph, video, testimonial, quote, statement, or other promotional material in order to claim or receive a prize.

11.5. If a winner voluntarily submits any photograph, video, testimonial, quote, statement, recording, or other content to IA4G in connection with a completed sweepstake ("Winner Promotional Materials"), the winner grants ITSALL4GOOD LLC a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable right and license to use, reproduce, edit, adapt, publish, display, distribute, transmit, create derivative works from, and otherwise use the Winner Promotional Materials, in whole or in part, in any media now known or later developed, for promotional, advertising, marketing, social-media, website, business, and other lawful purposes.

11.6. To the extent the winner owns any copyright or other transferable rights in Winner Promotional Materials, the winner assigns those rights to ITSALL4GOOD LLC, to the fullest extent permitted by applicable law. If any assignment is ineffective or unenforceable, the license granted above remains fully effective.

11.7. The winner represents that they have the right to submit the Winner Promotional Materials and grant the rights described in this section.

11.8. IA4G may use, edit, crop, combine, caption, or decline to use Winner Promotional Materials in its discretion, subject to applicable law.

18. FORCE MAJEURE

18.1. IA4G shall not be liable for any failure or non-performance of services due to causes beyond its reasonable control, including but not limited to acts of civil authorities, acts of military authorities, riots, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances and which may prevent the performance of our services.

19. DISPUTE RESOLUTION

19.1. Any dispute, claim, or controversy between the user and IA4G related to these Terms, the website, or the services shall be resolved exclusively through alternative dispute resolution methods.

19.2. Both parties will first attempt to resolve the matter informally through direct communication. Users may contact IA4G through its official support channels, and the company will respond within a reasonable period of time.

19.3. If the dispute is not resolved within thirty (30) days, it shall proceed to mediation before a neutral mediator agreed upon by both parties, or appointed by a recognized mediation agency if no agreement is reached within fifteen (15) additional days. Mediation costs will be shared equally, and sessions may take place in person or virtually.

19.4. If mediation fails, the matter shall be settled by binding arbitration under the commercial arbitration rules of the American Arbitration Association (AAA) or a similar institution. The arbitration shall be conducted in English, by a single neutral arbitrator, in the State of Florida. The arbitrator’s decision will be final and binding, and may be enforced in any competent court.

19.5. Both parties waive any right to bring a lawsuit in court or to participate in a class action, unless required by applicable law. IA4G may, however, seek injunctive or equitable relief directly in court for intellectual property violations, misuse of the platform, or actions causing irreparable harm.

19.6. Notwithstanding the foregoing, disputes arising specifically from participation in a Sweepstakes, including disputes relating to eligibility, entry validation, winner selection, prize fulfillment, odds, charitable donation administration, or interpretation of the applicable Official Sweepstakes Rules, shall be governed by the dispute-resolution provisions contained in the applicable Official Sweepstakes Rules.

20. APPLICABLE LAW

20.1. These terms of use shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles, except where applicable federal law controls. Subject to the dispute-resolution provisions in these terms, any permitted court proceeding shall be brought in a court of competent jurisdiction located in the State of Florida.

21. FINAL PROVISIONS
